Welcome to TouchBase Data ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the TouchBase Data website (the "Site") and the data bundle purchase services provided through the Site (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. About the Service

TouchBase Data is a platform that allows users in Ghana to purchase mobile data bundles for various networks. The Service operates on a no-registration basis. You can select your network, enter the recipient's phone number, and complete your purchase without creating an account.

2. Eligibility

By using the Service, you represent and warrant that:

• You are at least 18 years of age or have the legal capacity to enter into binding contracts.
• You are a resident of Ghana or are authorized to purchase data bundles for a Ghanaian mobile number.
• All information you provide is accurate, current, and complete.
• You will not use the Service for any illegal or unauthorized purpose.

3. Ordering & Delivery

When you place an order through TouchBase Data, the following terms apply:

• No Registration Required: You may purchase data bundles without creating an account. You are responsible for ensuring the accuracy of the phone number you enter.
• Instant Delivery: Data bundles are typically delivered within a few seconds to a few minutes after successful payment. However, delivery times may vary due to network conditions or technical issues.
• Recipient Number Accuracy: You are solely responsible for entering the correct recipient phone number. Orders sent to wrong numbers are not refunded.
• Airtime Debt: If the recipient's phone number has outstanding airtime debt, the data bundle may not be delivered. You must ensure that any owed airtime is paid before placing an order. If delivery fails due to unpaid airtime debt, no refund will be issued.
• Network Availability: Data bundle availability is subject to the respective mobile network operators. We are not liable for network downtime or failures that prevent delivery.

4. Refund Policy

Due to the nature of digital data bundles, all sales are generally final. However, we may consider refunds in the following limited circumstances:

• If your payment was successful but the data bundle was not delivered to the correct number within 24 hours, and the failure was not due to incorrect number entry or airtime debt.
• If you were charged multiple times for a single order due to a technical error on our platform.

No refunds will be issued for:

• Orders sent to the wrong phone number.
• Orders that failed to deliver because the recipient's phone number had unpaid airtime debt.
• Orders that were successfully delivered but the recipient claims non-receipt (we rely on network delivery confirmations).
• Change of mind after purchase.

To request a refund, please contact our support team with your transaction details within 48 hours of the order. Refunds are processed at our sole discretion and may take up to 7 business days to reflect.

5. Pricing and Payment

• All prices are displayed in Ghanaian Cedis (GHS) and are subject to change without notice.
• Payment must be made in full before data bundles are delivered.
• We are not responsible for any additional fees charged by your payment provider or mobile network.
• We reserve the right to modify or discontinue any data bundle offers at any time.

6. Prohibited Conduct

You agree not to:

• Use the Service for any fraudulent, abusive, or illegal activity.
• Attempt to interfere with the proper functioning of the Site or Service.
• Use automated systems (bots, scrapers) to access the Service without our express written permission.
• Resell data bundles purchased through TouchBase Data without authorization.
• Provide false or misleading information when using the Service.

7. Limitation of Liability

To the fullest extent permitted by law, TouchBase Data shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid for the specific transaction giving rise to the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
